Participant Terms and Conditions

Participation Agreement for yourself or as the parent/guardian of an under 18 participant

Read the following points carefully.

1. At Fenland Aquapark Ltd (the “Aquapark”) we take your health and safety seriously. We wish to highlight that participation in the Aquapark is strenuous and will also involve some swimming. It is therefore a potentially hazardous physical activity and any swimming can lead to a risk of injury and even death.

2. I understand and accept that in participating in water sports activities that there is an element of danger and risk of injury to others, and consequently undertake to use the Aquapark equipment and facilities and to conduct myself while on the Aquapark premises in a sensible, responsible manner and in compliance with all notices, instructions and directions given to me by an authorised person of the Aquapark. I have read and acknowledge that conduct of the type set out in Point 3 below would amount to a breach of this paragraph.

3. I will not use the Aquapark facilities whilst under the influence of any drugs or alcohol.

4. I am in a good state of health and free from any injury, medical condition, disease or illness that may be aggravated by participating in water sport activities or which may make it unsuitable for me to take part in such activities.

5. I can swim and am confident in deep water.

6. I will wear my buoyancy aid and helmet at all times and will not remove them whilst in the water.

7. When accompanying a child or children, I will comply and ensure that the child or children are safe and looked after. I will be present on site at all times and will not leave them unattended on Fenland Aquapark or Gildenburgh Water grounds at any time

8. I fully understand that no child under the age of 6 years of age is allowed in the water at any time.

9. I have acknowledged that there is a possibility of Fenland Aquapark Ltd taking photos for advertisement or promotional purposes. I am fully aware that I must contact a manager of Fenland Aquapark Ltd if I do not wish to appear in such photos.

10. I may be asked on arrival at the Aquapark for documentary proof of identity, booking and payment for myself and for an under 18 minor in my care, and for proof of age of the minor. I must be able to produce these documents if necessary. Failure to do so can result in being refused to partake in activities without refund.

11. I understand that booked timeslots on the Aquapark are subject to minimum and maximum numbers, and that Fenland Aquapark Ltd will provide safety staff in ratios proportionate to the booked numbers. In the event that a staff member is unwell, or has to self-isolate, and we are unable to find a replacement to comply with our safety ratios at short notice, we may contact you to re-arrange your session to another mutually convenient time. Equally, if the minimum threshold for participants has not been met in a session, we may contact you to see if you would be able to come at a session with more participants.

12. I acknowledge that nothing in these Terms and Conditions is intended to avoid liability, on the part of the Aquapark, for personal injury or death caused by negligence or wilful act of its authorised persons or agents.

13. I will fully indemnify the Aquapark, its agents, and employees against any claim brought by a third party for loss, damage, injury or death which has been caused by any action or omission or any act or omission of any child of which I am the lawful parent or guardian, or any child whose supervision is wholly or partly my responsibility at the time of the relevant act or omission that would, if they had agreed to the same with full capacity to do so, amount to a breach to the Terms and Conditions or which amounts to negligence or a wilful act or omission.

 14. Where specific features of the aquapark are not available due to maintenance, we reserve the right to make reasonable substitutions on the day. If this is not possible, we reserve the right to cancel the session at short notice. 

15. There is no guarantee that you will complete your Activity at the exact time given on your booking confirmation. If you are going to be late to your session, please ring in advance and we will try and accommodate you as best we can in a later session.

16. If you change your mind about your purchase, Fenland Aquapark Ltd will refund booked activities and vouchers bought direct from Fenland Aquapark within 14 days of purchase, minus a £5.00 administration fee, providing it is also 14 days or more before the date of the activity. After 14 days from booking and/or for less than 14 days before the activity, no refund will be given.

If you are unable to attend your booking, you must give a minimum of 48 hours’ notice in order to change your booking, otherwise your booking will be lost with no replacement, voucher or refund provided.

Payments made by debit card or credit card will be refunded to the same card or if the card has subsequently expired been lost or damaged payment shall be made by cheque or bank transfer. Any payment made by gift card or voucher will be refunded by the issuing of a replacement voucher or gift certificate for the same value. Where a multiple form of payment has been used, we reserve the right to refund or amend by credit, cheque, voucher of gift card.

17. It is the participant’s responsibility to ensure that they are in possession of their personal belongings following their experience. Fenland Aquapark has no liability to compensate or offer replacements for lost items.

18. There can be no guarantee that a particular date will not be withdrawn due to adverse weather conditions.If bad weather affects a booking it will be rescheduled by Fenland Aquapark Ltd at no extra charge to you for a later date. We will make every effort to reschedule it as soon as possible. No refunds will be given.

19. I have read the above and I agree to adhere to the guidance set by the staff.
